Modifies laws affecting public schools and school programs; incorporates Governor’s mill levy stabilization plan; raises the per pupil base amount by 4.6 percent; increases the total slots available in the Colorado Preschool and Kindergarten Program by 2,000 in FY 2007-08 and an additional 3,500 in FY 2008-09; increases funding for school districts now receiving the minimum state support; requires each school district to develop a plan to potentially phase-in a full-day kindergarten program; requires school districts to prepare annual budgets in a standard format.

Press release: Gov. Ritter signs 2007-08 fiscal budget bill, May 2, 2007 (from the Office of the Governor)
Governor's Headnote/Footnote Veto Message

Veto overrides: The Colorado Supreme Court has ruled that the governor cannot veto head notes. Although Gov. Ritter never used the term “veto,” he did strike out seven head notes. The legislature is now asking the Colorado Supreme Court to determine whether this “strike out” constitutes a veto by the governor.

The legislature also challenged the Governor’s authority by overturning his footnote vetoes. Footnotes allow the legislature to set policy or use funds allocated in the Long Bill. This challenge will likely be heard by the Colorado Supreme Court, as to whether the legislature, i.e. the JBC, has the power to set policy related to appropriations in the budget.

Warrants and Bonds for Illegal Immigrants: Requires courts to issue a warrant for anyone turned over to the federal Immigration and Customs Enforcement (ICE) who has posted bond on a criminal charge; requires warrants to be listed in Colorado and national crime data bases. Prohibits courts from dismissing charges upon deportation; charges can only be dismissed by the district attorney. Bond agents or others posting bonds must forfeit premiums or fees paid for deported defendants; forfeited fees are credited to the Corrections Expansion Reserve Fund.
FI: $1.1 million in FY 07-08; $949,747 in FY 08-09; $778,265 in FY 09-10. Local governments would also have increased costs of holding more prisoners in custody.

• A passport;
• A driver's license from Colorado or other states that verify lawful presence;

• Any other documents considered to be proof of identity by the federal government.
The bill also creates an appeal process for those denied a driver's license or ID card.

Board of Education Waiver Requirements: Requires a 2/3 majority of the State Board of Education to waive statutory education requirements. Requires school districts applying for waivers to show consent of a majority of the members of the appropriate accountability committee, a majority of the affected administrators, and a majority of the teachers in the affected school or school district. Limits waivers to a maximum of five years and provides a review process for the renewal of expired waivers.

Transition Between Private Market and CHP+: Requires some private health insurers to cover illnesses that children already had before enrolling in their health plan if those children were previously insured by the state's Children's Basic Health Plan (CHP+). Requires some private insurers to allow parents to add their children to a health plan at the time they lose their CHP+ coverage, even it it’s after the enrollment period. Requires parents to notify their current health insurer at least 30 days before transferring their children from private insurance to CHP+.
